Terms of service
Last updated: 17 October 2026
These Terms & Conditions apply to consumer purchases made through thesicilian.com. Please read them before placing an order. Separate terms may apply to wholesale orders or other arrangements expressly agreed with us.
Who We Are
This website is operated by The Sicilian 313 Railton Ltd, trading as The Sicilian Delicatessen, registered in England and Wales (company number 13238139; VAT number GB373722292).
Business address: 313 Railton Road, Herne Hill, London SE24 0JN, United Kingdom.
Email: info@thesicilian.com.
Using the Website
You agree to use this website lawfully and to provide accurate information when ordering. You must not misuse the website or interfere with its security or operation.
Products and Availability
We aim to describe our products accurately, including key ingredients, quantities, prices and other relevant information. Product appearance, batches and packaging can occasionally vary. If a product is unavailable after you place an order, we will contact you to agree an alternative or provide a refund for the unavailable item. We will not substitute an item without your agreement.
Food Information, Allergens and Storage
Please read the ingredients, allergen information, storage guidance and date markings provided on our product pages and product labels. If you have an allergy or specific dietary requirement, contact us before ordering if you need clarification. Allergens and other required food information must be available before an online purchase is completed and again when the goods are delivered.
Please follow all storage instructions, particularly for chilled foods, and refrigerate or consume perishable items promptly after delivery. Do not consume food that appears spoiled or unsafe.
Age-Restricted Products
We sell alcoholic products only to customers aged 18 or over. By placing an order for alcohol, you confirm that you are at least 18. We may undertake age-verification checks before accepting or dispatching an order. Alcohol must not be handed over to anyone under 18; the person delivering the order may request acceptable proof of age before handing it over. If the required age checks cannot be completed, we may be unable to fulfil or deliver the alcoholic products. We will contact you about the order and any refund due under applicable law. All alcohol sales and deliveries are subject to the licensing requirements that apply to them.
Prices, Taxes and Payments
All prices are shown in pounds sterling. Applicable taxes and delivery charges are shown before you complete your order. Payment must be made using one of the methods offered at checkout. We may correct obvious pricing or product errors before accepting an order; if this affects your order, we will contact you and you may choose whether to proceed at the corrected price.
Placing and Accepting Orders
After you place an order, we will send an acknowledgement to the email address supplied. This confirms that we have received your request, but it does not necessarily mean we have accepted it. An order is accepted when we send a dispatch confirmation, unless we expressly confirm acceptance earlier. If we cannot fulfil an order, we will tell you and refund any amount paid for items we cannot supply.
We will provide confirmation of your contract, including the required purchase and cancellation information where applicable, by email or another format you can save and refer to, no later than when the goods are delivered. You will have an opportunity to review your order details and correct mistakes before placing your order.
Delivery Areas, Charges and Times
We deliver to Great Britain (England, Scotland and Wales) using DPD. We do not currently deliver to Northern Ireland. Delivery is free on orders over £59; for orders of £59 or less, the delivery charge is shown at checkout.
Orders are normally dispatched on the next working day and usually arrive within 2–3 working days of the date the order is placed, excluding weekends and bank holidays. Delivery times are estimates. Courier disruption, weather and busy periods can cause delays. Please contact us if your order has not arrived when expected. Nothing in these terms limits your legal rights concerning delayed or missing deliveries.
Risk and Responsibility for Goods
We remain responsible for goods during transit until they are delivered into your physical possession or that of a person you have nominated to receive them, subject to the rules that apply if you independently appoint your own carrier.
Cancelling an Order or Changing Your Mind
For goods covered by the statutory online cancellation right, you can cancel within 14 days after delivery and then have a further 14 days to send the goods back. Goods liable to deteriorate or expire rapidly, and certain sealed goods unsuitable for return for hygiene reasons once unsealed, may be excluded from change-of-mind cancellation. Not all food products are exempt.
For an eligible change-of-mind return, you are responsible for the direct return postage cost, provided you were informed of this before ordering. Please see our Delivery and Returns Policy for instructions and the model cancellation form. These terms do not reduce your statutory cancellation rights.
Damaged, Faulty, Spoiled or Incorrect Goods
If an order arrives damaged, faulty, spoiled or incorrect, email info@thesicilian.com as soon as possible, ideally within 24 hours for fresh or chilled foods and within 48 hours for other items. Please include your order number and, where possible, photographs of the parcel, internal packaging and product. Those reporting periods are requested targets, not absolute legal deadlines. We will assess claims under UK consumer law, taking account of a food product's expected shelf life, and provide any remedy required by law.
Returns, Inspection and Refunds
For eligible change-of-mind returns, we ask that goods be securely packaged, preferably with original seals and packaging intact where possible. We may inspect returns and make legally permitted deductions if unnecessary handling has reduced their value. Food will not be resold unless we are satisfied that it is safe and suitable for resale.
Where a statutory refund is due, we will process it within the applicable legal timescale and use the original payment method unless otherwise agreed. Where the law requires it, refunds include the original basic delivery charge on cancellation of an entire eligible order. Please see our Delivery and Returns Policy for full details.
Subscriptions and Repeat Orders
Where the website offers an optional subscription or recurring delivery, the price, frequency, payment arrangements, how to change or cancel it and any applicable minimum term must be clearly displayed before you subscribe. Any specific subscription terms shown at checkout apply alongside these Terms & Conditions, without affecting your statutory rights.
Promotions and Gift Offers
Any voucher, promotion or special offer is subject to its stated conditions and availability. We will display material restrictions before purchase. We may refuse a promotion used fraudulently or contrary to its published conditions, without affecting an existing customer contract or statutory rights.
Website Content and Intellectual Property
Unless otherwise stated, the text, images, branding and other content on this website belong to The Sicilian or are used with permission. You may use the website for personal shopping and information, but must not reproduce its content commercially without permission.
Liability and Consumer Rights
Nothing in these Terms & Conditions excludes or limits liability where the law does not permit it, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights. We are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law.
Privacy
We use personal information in accordance with our Privacy Policy, which explains how personal information is collected, used and shared and how you can exercise your rights.
Changes to These Terms
We may update these Terms & Conditions from time to time. Changes will normally apply to orders placed after the updated terms are published, not retrospectively to orders already accepted, unless required by law.
Governing Law and Contact
These Terms & Conditions are governed by the laws of England and Wales, without removing any mandatory consumer protections that apply to you. Disputes may be brought before the courts with jurisdiction under applicable law.
